Chiikawa Market Terms of Service

Before using the market (hereinafter referred to as "this site"), please read the terms of use carefully.
When using this site provided by Gray Parker Service Co., Ltd. (hereinafter referred to as "the Company"), you are deemed to have agreed to all the contents of the terms of use. In addition, you must comply with the related laws. If you do not agree to the terms of use, please refrain from using this site.

【Regarding Use】

By using this site, you agree to comply with the terms of use at the time of use.

【Regarding Copyright】

All copyrights related to the content and information on this site belong to the Company or third parties authorized by the Company. Reproduction, distribution, sale, public display, etc., beyond the purpose of private use are prohibited.

【Changes to These Terms】

The Company may change these terms without prior notice or consent to customers.
For the use of this site after changes to these terms, the new terms after the change will apply.
The Company may request customers to agree to the new terms after the change.

【Regarding Changes and Suspension of Site Content】

The Company can change, suspend, or stop the content of this site without prior notice or consent. The Company assumes no responsibility for any damages caused by changes, suspension, or stoppage of this site.

【Establishment of Purchase Agreement】

When a customer places an order on this site, it becomes an application for a contract. After the order is completed, the Company automatically sends an order completion email from the system, which is intended to notify that the customer's order process has been completed. At the time the Company ships the product, the customer's application is accepted and the contract is established, unless it falls under the reasons for cancellation or withdrawal of the contract specified later. Even after the establishment of the contract, if it is determined that it falls under the reasons for cancellation or withdrawal specified later, the contract may be canceled. Also, even if the order process is completed, there may be cases where the purchased product becomes out of stock due to the timing of payment acceptance. In this case, the purchase contract for the relevant product will be deemed canceled, and the Company will be exempt from the obligation to deliver the relevant product, etc. Furthermore, the Company assumes no responsibility for any damages incurred by customers due to non-delivery, except for the refund of the purchase price.

【Transfer of Ownership】

The ownership of the products purchased by the customer will be transferred when the products shipped by the Company arrive at the customer's designated delivery destination.

【Cancellation and Withdrawal of Contract】

The Company may cancel the contract after the customer has completed the order or after the Company has sent the order completion email, or even after the contract is established by shipping the product if the customer falls under any of the following reasons.

  1. If the result of screening by the credit card company is that approval or settlement cannot be received
  2. If it is found that there is false information in the customer's personal information, etc.
  3. If the ordered product is not scheduled to be in stock for a long time or if production is completed
  4. If an order is received for a quantity exceeding the specified quantity for limited quantity products
  5. If a violation of these terms, other Company regulations, or laws is recognized
  6. If there is an error in the price or other product information or sales conditions posted on this site
  7. If any reason equivalent to the above is recognized (including cases where the customer fell under any of the above in past transactions with the Company) or if the Company determines that it cannot respond to the order

【About Cancel】

After the Company sends the order completion email, the cancellation of the product is not accepted in principle. Even if the email is not received due to the customer's internet environment, it will not be accepted.

In case the product is returned to the store without being received
If the product is returned to the store after being shipped from the store and the customer does not receive it (including cases of refusal of receipt, expiration of the retention period due to absence, or unclear address, but not limited to these), the store will notify the customer's registered email address.
If you wish to have the product reshipped, please contact us by replying to the email from the store within one month after the email notification. Please note that reshipment will be done with postage due.
If one month has passed after the email notification from the store and there is still no reply or receipt, the order will be treated as canceled, and the following costs will be borne by the customer. If the product price has already been paid in advance, the remaining balance after deducting the customer's share will be refunded.

  • Delivery charges
    *Fees are based on the region-specific delivery charges determined by the store. Please check "Regarding Delivery" in User Guide for details.
    *Even in the case of free shipping orders, charges will be applied.
    *If reshipment occurs multiple times, delivery charges will be applied for each occurrence.
    *If return shipping charges are incurred separately due to the regulations of the delivery company, those charges will be borne by the customer additionally.
  • Actual costs such as handling fees incurred in connection with the ordered products (including wrapping fees, various service fees, but not limited to these).

【Regarding Returns and Exchanges】

Returns and exchanges of products are not accepted except for initial defects.
Exchanges for promotional items (novelties) that are not products, defects in outer packaging, or damages cannot be accepted.
If there is any defect or deficiency in the product after delivery, please contact the Chiikawa Market Customer Center from the Inquiry form within 7 days after the product arrives. In principle, defective products will be handled by exchange. However, if there is no stock for exchange or if the Company determines that exchange is inappropriate, a refund will be made.

Examples where returns are not accepted
(1) Initial defects after the response period has passed due to long-term storage, etc., from the product arrival date
(2) Products returned without prior notice
(3) Products that have been damaged or broken after use by the customer
(4) Exchange requests from parties other than the purchaser
(5) When purchased outside the official route such as auction sites, etc.
(6) When purchased from stores other than this site (including regular stores, physical stores, online stores, but not limited to these)
(7) Cases due to manufacturing characteristics

【Regarding Resale and Inappropriate Behavior】

Buying and reselling for profit purposes is prohibited.
If the Company determines that an act is for profit purposes, inappropriate behavior, or inappropriate (for example, repeat orders by individuals or groups for products with purchase limits, large orders or cancellations that are difficult to recognize as personal use, repeated or continuous resale of products, including but not limited to these), the Company may cancel, terminate, refuse future purchases, or take other appropriate measures at its discretion. In such cases, even if damages occur to the customer or a third party, the Company assumes no responsibility.

【Regarding Delivery】

Except for some products, products in stock will be delivered within 7 business days from the day after the order date, and Pre-orders start will be delivered within 7 business days from the release date.
Delivery may be delayed or not arrive on the desired delivery date and time due to weather, natural disasters, power outages, system troubles, incidents, accidents, or other reasons. In such cases, the Company assumes no responsibility for any damages incurred by the customer or third parties, as long as it is not due to the Company's willful misconduct.

【Regarding Delivery Area for Orders】

Shipping outside of Japan is not accepted.

【Regarding Member Registration】

(1) Registration of Member Information
Customers who wish to register member information must agree to these terms and register their member information according to the procedures specified separately by the company.

(2) Notification of Changes
In the event of changes to the content provided to the company, such as name, address, or phone number, the customer must promptly notify the company using the method specified by the company.

(3) Prohibition of Transfer, etc.
Rights obtained through the registration of member information cannot be transferred, sold, renamed, lent, or used by a third party, nor can they be provided as collateral.

(4) Cancellation of Member Information Registration
To cancel the registration of member information, the customer must notify the company using the specified method. Additionally, registered member information is considered personal and will be treated as having been notified upon the customer's death.

(5) Cancellation of Rights by Member Information Registration
If a customer who has registered member information meets any of the following conditions, the company may immediately cancel the customer's rights without prior notice. Furthermore, if the company takes the aforementioned measures and the customer or a third party suffers damage as a result, the company shall not be held responsible.

  • If there was falsification in the report or content provided to the company
  • If the credit card provided by the customer for settlement is no longer usable due to termination of the contract by the credit card company or other reasons
  • If there is a delay or default in the payment of fees, etc.
  • If contact with the customer who registered the information cannot be made through phone, fax, email, or other means
  • If there is a violation of these terms
  • If the company deems the situation inappropriate

In addition, regarding actions deemed inappropriate by the company, we ask for your understanding in advance that we will not provide an explanation for the reasons.

(6) Responsibility for Managing Member ID and Password
Customers must recognize that the member ID and password are important, and are solely responsible for managing them. Member IDs and passwords must not be transferred, sold, renamed, lent, or used by a third party, nor can they be provided as collateral.

(7) Prohibited Items
Customers who register member information must not engage in the following actions.

  • Submitting false registration information when using the service
  • Intentionally applying for multiple accounts to prioritize purchases
  • Actions that obstruct the operation of the service or pose a risk of interference with the service
  • Using the service with a fraudulently used credit card
  • Improperly using the member ID and password
  • Actions that cause trouble, disadvantage, or damage to other customers, third parties, or the company, or pose a risk thereof
  • Infringing on the copyrights, privacy, or other rights of other customers, third parties, or the company, or posing a risk thereof
  • Actions that violate public order and morals or other laws, or pose a risk thereof

【Protection of Personal Information】

Use of this site is contingent upon agreeing to the separately posted "Personal Information Protection Policy."

【Regarding Authentication】

This site employs SSL (Secure Socket Layer), a cryptographic communication technology deemed highly reliable on the internet, to protect personal information. However, the company does not guarantee its safety, and in the event of an accident such as the leakage of personal information without the company's fault, the company and each credit card company will not be held responsible.

【Regarding Deletion of Emails, etc.】

If the company receives emails that defame, slander, or violate these terms or the site, the company may delete such emails without any notice or response.

【Disclaimer】

The company shall not be liable for any damages incurred by the customer, the customer's related parties, or third parties due to the use or inability to use this site, except in cases where damage is explicitly specified in these terms or caused intentionally by the company.

【Regarding Jurisdiction】

The exclusive jurisdiction for any disputes arising between the customer or related parties and the company in relation to this site shall be the Tokyo District Court or the Tokyo Summary Court.

【Governing Law】

The interpretation and application of these terms shall be governed by Japanese law.
